PROPOSED SUBSTITUTE ORDINANCE

 

DATABASE ORDINANCE

 

WHEREAS, the Cook County Assessor’s Office maintains a database (the “Database”) of certain property identification numbers, address information, property characteristics and images for all parcels in Cook County for the purposes of real estate taxation; and

 

WHEREAS, the Database is currently available to all taxpayers on the Cook County Assessor’s website at no charge; and

 

WHEREAS, the Database is currently available on a PIN by PIN basis only; and

 

WHEREAS, certain organizations desire the ability to access and compile the Data in a bulk form; and

 

WHEREAS, the Cook County Board of Commissioners desires to establish fair and reasonable public access to the Database while maintaining website access at no charge; and

 

WHEREAS, the County asserts copyright protection for the Database.

 

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF COOK, as follows:

 

Section 1.     Definitions:  The following term used in this ordinance shall have the meaning set forth below:

 

                        “CCAO Database”: means an electronic database maintained by the Cook County Assessor’s Office containing property identification numbers, address information, property characteristics, and geocode information for all parcels in Cook County for the purposes of real estate taxation.

 

Section 2.     The CCAO Database shall be made available on an annual subscription basis for a fee payable in cash, money order, or certified or cashier’s check in one installment.  The fee for the subscription service shall be made available to subscribers for a fee.  This fee will start at $30,000 and will increase with the number of users as reflected in Chapter 32-1, the Fee Section of the Cook County Ordinance.  Those fees shall be adjusted annually by the Consumer Price Index as of January 1 of each year following the effective date of this Ordinance.

 

Section 3.     To further carryout the intent of the section above, the Cook County Assessor’s Office may enter into agreements substantially similar to the form of agreement submitted herewith as Exhibit A.

 

 

 

 

 

Section 4.     It shall be the duty of the County Assessor to collect and receive for the County’s general fund the subscription fees imposed by this ordinance.  The County Assessor shall adopt, promulgate and enforce rules and regulations not inconsistent with this ordinance relating to the administration and enforcement of the provisions of this ordinance.  Such rules and regulations shall be consistent with the provisions of this ordinance designed to promote fairness.  The Cook County Auditor is hereby authorized to examine the books, papers and records of any such subscription agreement during regular business hours.

 

Section 5.     The Assessor may implement reasonable security precautions to prevent users of the website from downloading significant quantities of data from the publicly available website.  However, those precautions shall not prevent the regular use of the website by the public or individuals not engaged in automated or high volume repetitive search practices which can slow the performance of the site.

 

Section 6.     This ordinance shall be effective upon its passage by the Cook County Board of Commissioners.

PROPOSED SECOND SUBSTITUTE ORDINANCE

FOR COMMUNICATION NUMBER 284782

 

COOK COUNTY ASSESSOR’S OFFICE DATABASE FEES

 

WHEREAS, the Cook County Assessor’s Office maintains a database (the “Database”) of certain property identification numbers, address information, property characteristics and images for all parcels in Cook County for the purposes of real estate taxation; and

 

WHEREAS, the Database is currently available to all taxpayers on the Cook County Assessor’s website at no charge; and

 

WHEREAS, the Database is currently available on a PIN by PIN basis only; and

 

WHEREAS, some website users have employed automated or repetitive searches which slows and sometimes freezes the Cook County Assessor’s website; and

 

WHEREAS, certain organizations desire the ability to access and compile the Data in a bulk form without impairing the functionality of the Cook County Assessor’s website; and

 

 

WHEREAS, the Cook County Board of Commissioners desires to establish fair and reasonable public access to the Database while maintaining website access at no charge; and

 

WHEREAS, the Cook County Assessor’s Office may enter into agreements substantially similar to the form of agreement submitted herewith as Exhibit A; and

 

WHEREAS, the County asserts copyright protection for the Database.

 

NOW, THEREFORE, BE IT ORDAINED, by the Cook County Board of Commissioners that Chapter 2, Article IV, Section 2-315 is hereby enacted as follows:

 

Division 7.  Assessor

 

Sec. 2-315.    Cook County Assessor’s Office database fee.

 

(a)       Definitions.  The following terms used in this ordinance shall have the meaning set forth below:

 

                        CCAO Database means an electronic database maintained by the Cook County Assessor’s Office containing property identification numbers, address information, property characteristics for all parcels in Cook County for the purposes of real estate taxation.

 

                        Commercial User:  means any individual, firm or organization accessing the CCAO Database for a commercial interest rather than a public, not for profit, or educational interest.

 

                        Repetitive Searches:  means any program or computer procedure written, developed, purchased, or implemented for the purpose of downloading or accessing data from the CCAO Database, including, but not limited to searching for more than 100 property searches of the CCAO database by a Commercial User in a given day.

 

            (b)       Fee Structure.  The CCAO Database shall be made available on an annual subscription basis for a fee payable in cash, money order, or certified or cashier’s check in one installment.  Fees will be imposed as follows:

 

            The CCAO shall assign one to five authorized user account - $15K annually.  Each authorized user account will be issued a username and password, with access to our search engine without any capability to download data.  Enhanced customized search features will be included, strictly viewing only.

 

            The CCAO shall assign six to one hundred authorized user accounts - $30K annually.  Each authorized user account would have full unlimited access, be able to download our database and have access to enhanced customized search features.

 

            The CCAO shall assign more than one hundred authorized user accounts - $60K annually.  Each authorized user account would have full unlimited access, be able to download our database and have enhanced access to customized search features.

 

            These fees shall be adjusted annually by the Consumer Price Index as of January 1 of each year following the effective date of this Ordinance.

 

            (c)        Agreement Form.  To further carryout the intent of the section above, the Cook County Assessor’s Office may enter into agreements using a form of agreement similar to that outlined in Exhibit A.

 

            (d)       Fee Requirements.  It shall be the duty of the County Assessor to collect and receive for the County’s general fund the subscription fees imposed by this ordinance.  The County Assessor shall adopt, promulgate and enforce rules and regulations not inconsistent with this ordinance relating to the administration and enforcement of the provisions of this ordinance.  Such rules and regulations shall be consistent with the provisions of this ordinance designed to promote fairness.  The Cook County Auditor is hereby authorized to examine the books, papers and records of any such subscription agreement during regular business hours.

 

            (e)       Repetitive searches of the website.  The Assessor may implement reasonable procedures to prevent users of the website from performing repetitive searches or downloading significant quantities of data from the publicly available website.  However, those procedures shall not prevent the regular use of the website by the public or individuals not engaged in repetitive searches which can slow the performance of the site.

 

(f)      Effective Date.  This ordinance shall be effective upon its passage by the Cook County Board of Commissioners.

 

COMMISSIONER GORMAN, SECONDED BY COMMISSIONER MURPHY, MOVED THAT THE SECOND SUBSTITUTE ORDNANCE BE APPROVED AND ADOPTED.

 

The Chair ruled that the second substitute ordinance was out of order due to failure to comply with notice requirements.  Following discussion, the ruling was withdrawn and the motion to approve was allowed to stand.

 

Chairman Daley and Commissioners Claypool, Peraica and Suffredin removed their names as co-sponsors of the Proposed Second Substitute Ordinance.

WHEREAS, in times of difficult financial constraints, it is imperative to scrutinize any appointment to executive or administrative positions; and

 

WHEREAS, the President and Board of Commissioners recently approved a desk audit of all employees of County government, and is considering a management audit of employees in these same Grades 17 through 24; and

 

WHEREAS, the Board of Commissioners recognizes the statutory authority of the President in appointing various employees exempt under the federal court’s Shakman decree on hiring.

 

NOW, THEREFORE, BE IT RESOLVED, that within ten days of the appointment of any executive or administrative employee, in Grade 17 through 24 positions, that written notice be submitted to the members of the Board of Commissioners stating the position title, department, justification for the need to fill that position, and the name of the appointed individual.

 

That said requirement apply to executive and administrative positions in all County offices, including those under the jurisdiction and authority of the separately elected County officials, and including special administrative designations in the offices of the State’s Attorney, Public Defender and the hospitals and clinics operated by the Bureau of Health Services; and

 

That this requirement shall not apply to positions requiring a professional license for such position, such as those required of lawyers, doctors, architects, engineers and any other profession requiring a license to practice or perform that specific profession, except for those being appointed to supervisory positions for such professions, or those appointments requiring consent by the Board of Commissioners.

RESOLUTION REQUIRING AN INDEPENDENT MANAGEMENT AUDIT

OF ALL POSITIONS CLASSIFIED AS GRADES 17 THROUGH 24

INCLUDING POSITIONS EXEMPT UNDER THE

FEDERAL COURT SHAKMAN CONSENT DECREE

 

WHEREAS, the 2007 Cook County government budget includes approximately 400 employees in those offices under the direct authority of the President of the Board of Commissioners, and several hundred more in those offices of the separately elected County officials, which are classified as Grades 17 through 24; and

 

WHEREAS, it is imperative to determine the exact nature of the duties of these higher grade employees, as to whether these positions are classified properly, as to whether these positions are executive, administrative or professional, or some combination thereof, in nature; and

 

WHEREAS, it is imperative that the management structure of Cook County government be revised in light of personnel reductions and a philosophy of streamlining bureaucracy; and

 

WHEREAS, it is imperative that the best possible candidates be placed in these positions, whether through the human resources process for non-Shakman exempt employees, or whether they are appointed by a County official, with or without consent of the Board of Commissioners; and

 

WHEREAS, that Cook County government be evaluated to determine that the levels of management, as well as the number of bureaus, departments and sections of the bureaucracy be appropriate and in the best interests of the people of Cook County; and

 

WHEREAS, the Cook County Board of Commissioners has recently approved a resolution to conduct desk audits of all employees of Cook County government by the County’s industrial engineers, any management level audit must be independent of the administration, and must be done within a shorter period of time possible by the County’s limited number of industrial engineers.

 

NOW, THEREFORE, BE IT RESOLVED, that the President and Board of Commissioners do hereby:

 

1)         authorize a request for qualifications proposals to select an independent management firm to perform an audit of all Grade 17 through 24 positions in Cook County government.

 

2)         require that responding firms be reviewed by the President and Board of Commissioners in public session with invitations extended to attend said meeting to the separately elected county officials, the Chicago Civic Federation, the Chicago Federation of Labor, other labor groups, the press and other interested civic and community organizations.

 

3)         set a schedule that such firm be selected no later than May July 1, 2007, that their audit be completed no later than July September 1, 2007, and that their report be presented to the Board no later than September 15 October 1, 2007, so that the results of said audit are available to the President and Board of Commissioners, and the separately elected County officials in preparation of the 2008 budget.

 

4)         and that said report incorporate the information requested in the “whereas” clauses stated herein.
