Cook County, et al., USDC No. 01-C-3638.  This matter was brought as a sexual harassment claim under Title VII of the Civil Rights Act of 1964 and an action for assault and battery against several County employees, arising out of Plaintiff’s employment at Stroger Hospital of Cook County.  The matter has been settled for the sum of $675,000.00 to resolve all claims, which is within the authority granted to this office by the Finance Committee’s Subcommittee on Litigation during a telephone poll which closed on May 11, 2007.  State's Attorney recommends payment of $675,000.00 in two (2) separate checks as follows:

 

1.  $192,000.00 made payable to Laura Phelan; and

 

2.  $483,000.00 made payable to Holman & Stefanowicz, LLC.

STATE'S ATTORNEY, Richard A. Devine, submitting communication advising the County of attorney fees and costs in the amount of $127,800.00 pertaining to a judgment regarding Wendell Reyes v. Cook County, USDC No. 02-C-3920.  The Cook County Board of Commissioners approved the judgment in this matter on April 18, 2007 (See Comm. No. 286188).  This matter was brought by plaintiff under Title VII of the Civil Rights Act of 1964 alleging gender discrimination.  The Finance Committee’s Subcommittee on Litigation approved payment of the attorney fees and costs pertaining to the judgment at its meeting of May 1, 2007.  State's Attorney recommends payment of $127,800.00 in four (4) separate checks as follows:

Cook County, Illinois Department of Human Rights Case No. 2006-CN-3624.  This matter was brought under the Illinois Human Rights Act, alleges that the complainant was subjected to harassment on the basis of her sexual orientation.  The matter has been settled for the sum of $500.00, which is within the grant of authority conveyed by the Cook County Board of Commissioners to the State's Attorney's Office.  State's Attorney recommends payment of $500.00, made payable to Monica Jackson.  Please forward the check to Michael D. PATIENT/ARRESTEE SETTLEMENT PROGRAM CLAIMS.  The Department of Risk Management is submitting invoices totaling $106,657.27, for payment of medical bills for services rendered to patients while in the custody of the Cook County Sheriff’s Office.  Their services were rendered under the Patient/Arrestee Settlement Program (499-274 Account).  Bills were approved for payment after an audit by Cambridge Integrated Services Group, and by the Department of Risk Management who recommends payment based on Cook County State’s Attorney’s Legal Opinion No. 1879, dated July 14, 1987.  Individual checks will be issued by the Comptroller in accordance with the attached report prepared by the Department of Risk Management.

COMCAST CABLE COMMUNICATIONS, INC. (PROPOSED FRANCHISE RENEWAL AGREEMENT).  Transmitting a Communication, dated May 11, 2007 from Mark Kilgallon, Chief Administrative Officer, Bureau of Administration:

 

On behalf of the County Cable Negotiation Team, approval is requested for the franchise renewal agreement with Comcast Cable Communications, Inc. to provide cable television services for Unincorporated Cook County.

 

Lengthy negotiations secured the following significant terms:

 

Term:                         Five (5) years, with two successive two- year renewal options.

 

                                    Comcast has agreed to a minimum three-year term if pending legislation eliminates local franchising but does not pre-empt existing franchises.

 

Revenues:               5% of Comcast Cable’s gross revenues, the statutory maximum approximately $1,000,000.

 

County Channel:    Comcast will provide the County with access to a cable channel upon the County’s request.

 

                                    Service will be available to all areas of the County within 18 to 24 months.

 

Capital Grant:          Comcast will provide the County with a capital grant to assist in funding the equipment necessary to establish the County channel.

 

                                    This grant will be funded through a Public, Educational and Governmental (P.E.G.) Capital Fee of $0.35 per month per subscriber for the first twelve months of the franchise agreement.

 

In addition to the above, the County has negotiated improved reporting and auditing provisions of gross revenues and the strengthening of the County’s remedies in the event of defaults.
