Sheahan, et al., Case No. 97-C-4568.  This lawsuit was filed against the Sheriff of Cook County and several individual employees and arises out of plaintiff’s claims under Title VII and Section 1983 stemming from her employment in the former Metropolitan Enforcement Group of Cook County.  The parties have settled the lawsuit for the sum of $750,000.00, which is within the authority granted to this office by the Finance Committee’s Subcommittee on Litigation at its meeting of April 9, 2008 recessed and reconvened on April 10, 2008.  State's Attorney recommends payment of $750,000.00, made payable to Yorli Huff, and Miner, Barnhill & Garland, P.C. and Andre M. PURSUANT TO THE HOME RULE AUTHORITY OF THE COUNTY OF COOK AS VESTED IN IT BY THE ILLINOIS CONSTITUTION is hereby enacted the following Ordinance:

 

When a document is returned to the customer by the U.S. Postal Service, the Recorder of Deeds is hereby authorized to charge, in addition to the recording fees, postage and handling fee of $2.25.  The Recorder of Deeds is authorized to modify the postage rate to reflect increases by the U.S. Postal Service.

 

The Recorder of Deeds is further authorized to rent mail type boxes to customers for delivery of documents from the Recorder of Deeds Office.  The Rental for each box shall be $20.00 per month.

 

This Ordinance shall be in full force and effect 30 days after passage by the Board of County Commissioners.

RECORDER POSTAL FEE ORDINANCE AMENDMENT

 

WHEREAS, Cook County is a “home rule” unit of local government pursuant to Article VII, section 6(a) of the 1970 Illinois Constitution, and as such, may exercise any power and perform any function pertaining to its government and affairs; and

 

WHEREAS, when a customer of the Recorder of Deeds requests that a transaction be returned to the customer by the U.S. Postal Service, the Recorder of Deeds is authorized, by Sec. 2-217 of the County Code, to charge, in addition to the recording fees, a service charge for each document that shall be mailed to the customer; and

 

WHEREAS, the Recorder of Deeds is further authorized, by Sec. 2-217, to rent mail type boxes to customers for delivery of its documents from the Recorder of Deeds office; and

 

WHEREAS, these two fees need to be increased to cover the Recorder’s costs for these services.

 

NOW, THEREFORE, BE IT ORDAINED, by the Cook County Board of Commissioners that Chapter 32 Fees, Sec. 32-1 of the Cook County Code is hereby amended as follows:

WHEREAS, pursuant to Counties Code, Fees 55 ILCS 5/3-5018 and Public records; Internet Access 55 ILCS 5/5 – 1106.1, the Recorder has been expressly authorized to charge a fee for obtaining documents on the Internet for the purpose of offsetting the expense of providing such access; and 

 

WHEREAS, Cook County is a “home rule” unit of local government, pursuant to Article VII, section 6(a) of the 1970 Illinois Constitution, and as such, may exercise any power and perform any function pertaining to its government and affairs; and

 

WHEREAS, the Counties Code, Fees of Recorder in Third Class Counties, 55 ILCS 5/4- 12002, as amended by P.A. 93-671 effective June 1, 2004 authorizes the Recorder to charge a fee for providing non-certified copies of documents in an amount of up to one half the fee charged for providing certified copies; and

 

WHEREAS, on September 21, 2004, the Recorder Internet Document Fee Ordinance was passed, providing a $.50 fee for an Internet copy; and

 

WHEREAS, the Industrial Engineers surveyed the recording process and performed a cost analysis.

 

NOW, THEREFORE, BE IT ORDAINED, for electronic copies of recorded documents obtained from the Recorder’s Internet Website, the Recorder is hereby authorized to charge $1.50 per document. 

 

This ordinance shall be effective on passage.
