Ladies and Gentlemen:

 

        Your Committee on Legislation, Intergovernmental and Veterans Relations of the Board of Commissioners of Cook County met pursuant to notice on Tuesday, October 2, 2007 at the hour of 9:30 A.M. in the Board Room, Room 569, County Building, 118 North Clark Street, Chicago, Illinois.

 

        Your Committee has considered the following item and upon adoption of this report, the recommendations are as follows:

AMENDMENT TO THE COOK COUNTY CODE, CHAPTER 26 EMERGENCY MANAGEMENT AND SERVICES, SECTIONS 26-31 THROUGH 26-44, (EMERGENCY MANAGEMENT AGENCY ORDINANCE) (PROPOSED ORDINANCE AMENDMENT).  SUBMITTING A PROPOSED ORDINANCE AMENDMENT SPONSORED BY TODD H. STROGER, PRESIDENT, COOK COUNTY BOARD OF COMMISSIONERS.

 

The following is a synopsis of the Proposed Ordinance Amendment:

 

 

PROPOSED ORDINANCE AMENDMENT

 

AMENDMENT TO EMERGENCY SERVICES

AND DISASTER AGENCY ORDINANCE

 

WHEREAS, the County of Cook is a home rule unit of government as defined in Article VII, Section 6(a) of the 1970 Constitution of the State of Illinois, and as such may exercise any power and perform any function pertaining to its government and affairs; and

 

WHEREAS, through Section 10 of the Illinois Emergency Management Agency Act (20 ILCS 3305/10), the General Assembly has provided that “each county shall maintain an emergency services and disaster agency that has jurisdiction over and serves the entire county, except … that in any county over 3,000,000 containing a municipality with a population over 500,000 the jurisdiction of the county agency shall not extend to the municipality when the municipality has established its own agency.”

 

NOW, THEREFORE, BE IT ORDAINED, by the Cook County Board of Commissioners that Chapter 26 Emergency Management and Services, Article II, Sections 26-31 through Section 26-434, the “Emergency Services and Disaster Agency Ordinance”, henceforth known as the “Cook County Emergency Management Agency Ordinance”, of the Cook County Code is hereby amended as follows:

 

ARTICLE II.  EMERGENCY SERVICES AND DISASTER AGENCY

COOK COUNTY EMERGENCY MANAGEMENT AGENCY

 

Sec. 26-31.  Establishment.

 

Sec. 26-32.  Coordinator.

 

Sec. 26-33.  Functions.

 

Sec. 26-34.  Service as mobile support team.

 

 

Sec.  26-35.  Agreements with other political subdivisions.

 

Sec.  26-36.  Emergency action.

 

 

Sec.  26-37.  Compensation.

 

Sec. 26-38.  Purchases and expenditures Reimbursement by state; funds received from federal government and private donation.

 

Sec. 26-39.  Oath Emergency Powers of President and Coordinator.

 

Sec.  26-40.  Office Oath.

 

Sec.  26-41.  Designation of Space.

 

Sec.  26-42.  Duty to Cooperate.

 

Sec.  26-43.  Construction.

 

Enforcement Date.  This amendment shall be in force from the date of passage.

Commissioner Murphy, seconded by Commissioner Steele, moved the approval of the Substitute Ordinance Amendment (Communication Number 289085). The motion carried.

 

Commissioner Goslin, seconded by Commission Steele, moved to adjourn the meeting.  The motion carried and the meeting was adjourned.
